Pre-requisite Courses and Assumed Knowledge and Capabilities

Successful completion of VCE English Units 3 and 4 or equivalent. The requirement is for students to be able to demonstrate the ability to comprehend and communicate information in accurate, clear and concise English. A basic understanding of the process of problem-based learning is also required. This includes the development and use of analytical skills. In addition, students are required to have an understanding of commercial law principles and the ability to read legislation. This knowledge is introduced in Commercial Law and students are strongly recommended to have completed Commercial Law prior to enrolling in Law of Investments and Financial Markets.


Course Description

The course examines the areas of law that impact on investors and those working in industries associated with investment products. Various forms of investment are considered including financial services and products, managed investments, real property and direct investments into companies.

Law of Investments and Financial Markets is an elective unit and is open to all students who have satisfied the pre-requisite courses and assumed knowledge and capabilities detailed above.


Objectives/Learning Outcomes/Capability Development

Upon successful completion of this course students will be able to:

 

  1. Understand the Corporations Act 2001, relevant case law and ASIC regulations. 
  2. Demonstrate an understanding of the underlying principles of corporate finance law.
  3. Apply the key legal rules associated with a range of investments and associated issues. In addition, the course provides an opportunity for students to develop generic capabilities. These include the ability to: read and comprehend legislation and relevant common law.
  4. Identify and critically analyse legal and associated issues in the context of relevant legislation and common law.
  5. Express that analysis in writing in a precise manner.
  6. Problem solve, involving the application of knowledge to current issues.


Overview of Learning Activities

Learning activities are designed around case studies and problems that encourage critical discussion during tutorials.

Students are required to prepare answers to tutorial problems prior to class each week. This ensures that valuable discussion, extension of concepts and issues requiring clarification can be addressed in weekly tutorials.

Students will also engage in legal research by traditional means, electronic legal databases and internet searching.
