Course Description

This course provides you with detailed knowledge of the law of evidence and procedure as it applies in civil and criminal trials. You will examine the theory underpinning the law of evidence, how evidence is adduced in trials, why evidence may be admissible or inadmissible, and develop the understanding of what should be included in a brief to counsel.

On successful completion of this course you will be able to:

  1. Analyse the concept and nature of evidence when a given set of case file materials and legal case to prove.
  2. Recognise the general principles and rules of evidence and in particular the rules as they apply to the conduct of a civil and criminal trial.
  3. Analyse the framework of statutory and common law rules which provide the basis for the exclusion, and inclusion, of evidence.
  4. Determine and evaluate the provisions of Victorian and Commonwealth legislation applicable in evidence law.
  5. Demonstrate skills in legal research and writing, critical analysis, legal problem solving, advocacy, client presentation and communication

These may include quizzes; assignments; prescribed readings; sourcing, researching and analysing specific information; solving problems; conducting presentations; producing written work and collaborating with peers on set tasks or projects.
