Course Description
This course provides you with knowledge and skills relevant to the major steps in litigation using the rules of the courts of Victoria and in particular rules of civil proceedings in the Supreme Court. The major steps in litigation which are examined include pleadings, ways of obtaining information from other parties and preparation for trial. You will also analyse the forms of alternative dispute resolution.
Objectives/Learning Outcomes/Capability Development

On successful completion of this course you will be able to:
- Identify and apply the structure and respective civil jurisdictions of Victorian and Federal courts and the history and sources of the law and practice relating to civil procedure.
- Identify the circumstances under which a summary judgement may be obtained
- Identify and apply law and practices to situations where there is more than one plaintiff or defendant, and where a defendant makes a claim against the plaintiff or another person
- Analyse and apply the procedures used to obtain information from other parties in a case, and the process of preparing for a final hearing
- Identify and explain the process of enforcing court orders.
- Analyse and apply ethical considerations regarding litigation, the law relating to legal costs, and methods of resolving disputes outside of the court system.
