Course Description

Advanced Principles of Contract Law is based on the foundational skills and knowledge obtained in 054908Introduction to Contract Law. This course will provide students an overview of the vitiating factors under common law and statute. It also examines performance of the contract, discharge or termination of the contract, and the relevant remedies available at common law and in equity for breach of contract.

Upon successful completion of this course, you will:

CLO1: Demonstrate an understanding of fundamental principles and rules governing vitiating factors, performance and breach, discharge, and remedies in Australian contract law;

CLO2: Identify, interpret, and apply legal principles to analyse fact scenarios and use professional judgement to generate practical, well-reasoned, and appropriate responses amongst alternative arguments at common law, in equity and under statute;

CLO3: Provide well-substantiated legal analysis and advice on a contractual problem to clients and other stakeholders;

CLO4: Develop and demonstrate legal research and analysis skills and use a variety of primary and secondary sources to support conclusions;

CLO5: Critique the broad theoretical basis of the law of contract and its social context.

To achieve the objectives this course requires you to participate in various learning activities. These activities comprise of lectures, tutorials, self-directed learning, participation through in-class and online activities, legal writing exercises, multiple choice questions, collaborating with peers on set tasks or projects, and a final examination.
