Course Description

This course provides an introduction to advocacy in trials in the Australian adversarial system. The aim is to introduce law students to aspects of trial advocacy and cases to assist students to practice as advocates. The course develops student legal practice skills including in examination in chief, cross examination, the role of expert witnesses, forensic evidence and closing arguments. The course also engages with legal research and analytical skills to support and develop a trial case.

Upon successful completion of this course, you will: 

CLO1: Explain and appraise the construction of adversarial legal systems and trials.  

CLO2: Analyse and research complex legal problems relating to trial advocacy.

CLO3: Demonstrate legal skills including examination in chief, cross examination, the role of expert witnesses, forensic evidence and closing arguments in a legal simulation. 

CLO4: Explain the ethical considerations and their application in legal advocacy.

To achieve the objectives listed above this course requires you to participate in various learning activities. These activities generally comprise the following: 

• Leading and participating in class discussion on legal problems and policy issues and engaging in roleplays; 
• Engaging in legal research by traditional means but also using electronic legal data bases and internet searching. 

Participating in legal role-plays and a courtroom simulation.
