This course examines insolvency principles and the relevant provisions of the Corporations Act and the Bankruptcy Act. Specific areas of study include the processes by which insolvency proceedings are instituted; different forms of administration of insolvent companies; arrangements under the Bankruptcy Act; the effect of insolvency on the debtor; and the powers and duties of the insolvency practitioner. Cross border insolvency will also be covered.
