This course explores the dynamic field of transitional justice, its theoretical principles, legal mechanisms, and practical application to mass human rights abuses. Transitional justice is rooted in the development of international criminal law, international human rights law, and conflict resolution theory. Students will learn about the various connections and tensions between the concepts of criminal justice, truth-telling, and reconciliation. They will study the transitional justice mechanisms that have operated in various areas of conflict, including the Truth and Reconciliation Commission in South Africa, the International criminal Tribunal of Rwanda, and civil society projects. Students will become familiar with the content and legal sources of transitional justice, such as the right to truth, the right to justice, and the right to a remedy.
