In this course you will examine the relationship between Indigenous peoples in Australia, and Australian legal systems and institutions. Indigenous peoples practice their own forms of law, which have pre-dated colonisation and continue to this day. Indigenous peoples also claim and reiterate particular rights in relation to the Australian state. At the same time, Australian legal systems and institutions have facilitated dispossession of Indigenous peoples. This course will introduce you to this complex relationship, with an emphasis on the strength of Indigenous rights and laws. You will engage with questions of Indigeneity, sovereignty, self-determination, political participation and voice, and rights to land, sea and sky country. We will consider how Indigenous peoples have claimed and asserted these rights, and how the state has responded. The course will reiterate the importance of cultural safety in legal practice; and will build the skills of students to develop cultural competency in future legal practice and to be capable of working together with Indigenous peoples who are claiming their rights.
