Course Description

The course teaches legal principles important in a commercial environment, focussing particularly on the principles needed by accountants providing professional accountancy services, including the law of contract, negligence and company law. This course will allow you to develop skills in reading, understanding and applying relevant legal principles from both legislation and court decisions, and you will be exposed to critical thinking about the socio-legal framework and legal and ethical standards underpinning the practice of accountancy and business in general.

In this course, you will acquire the knowledge of legal principles underpinning various business structures and transactions, including law of contract and negligence, and focussing on the principles relating to and regulating registered companies. It aims to provide you with an understanding of the legal environment and ethical framework within which companies operate in Australia and internationally.

On completion of the course you should be able to:

  1. Identify key elements of the Australian legal and ethical framework that underpin business and commercial situations, including the law of contract, law of negligence and company law, and apply them to complex legal problems and case studies.  
  2. Critically explore and evaluate legal principles relevant to business professionals and apply case and statutory law to solve practical legal problems. 
  3. Analyse and research complex legal problems relating to business and company law and compose a reasoned legal opinion to discuss the strength (and weaknesses) of various courses of action. 
  4. Identify and evaluate the various forms of business structures available and provide clear recommendations to a client on the applicability and impact to a given broad commercial and corporate contexts. 
  5. Generate and apply sophisticated legal problem-solving skills by using principles of negligence, contract law, and company law to analyse and respond to practical fact-based scenarios. 
  6. Identify and critically analyse legal risks in commercial transactions and advise on the legal mechanisms available to address or mitigate potential concerns.

These may include quizzes; assignments; prescribed readings; sourcing, researching and analysing specific information; solving problems; conducting presentations; producing written work and collaborating with peers on set tasks or projects.
