Course Description

This course will develop your skills and knowledge within the specialised area of construction contract law. The objectives of this course are to develop your critical understanding of construction contract legislation, And your ability to apply construction contract legal principles to practice. Topics covered will include: 

  • Standard construction contracts; 
  • Contentious clauses and the transfer of risk within contracts; 
  • Various forms of contract and procurement methods; Variations to contracts, claims, dispute resolution and related issues.

  • PLO3: Apply logical, critical and creative thinking to analyse, synthesise and apply theoretical knowledge, and technical skills, to formulate evidenced based solutions to industry problems or issues
  • PLO5: Collaborate effectively with others and demonstrate intellectual independence and autonomy to solve problems and/or address industry issues and imperatives

Upon successful completion of this course, you will be able to:

  1. CLO1: Describe and contrast different types of construction contracts
  2. CLO2: Identify and communicate the main sources of contractual disputes within the construction industry
  3. CLO3: Compare and contrast different types of contract clauses
  4. CLO4: Identify, analyse and justify variations to contracts
  5. CLO5: Analyse the implications of variations in contracts, and claims, including in relation to dispute resolution
  6. CLO6: Analyse various forms of contract and procurement routes

You will be able to engage in a variety of lectures and smaller classes. Learning activities may include class discussions, group work and problem based case study analysis.
